TO: All Concerned Persons
1. On May 13, 2022, the Department of Public Health and Human Services published MAR Notice No. 37-993 pertaining to the public hearing on the proposed amendment of the above-stated rule at page 672 of the 2022 Montana Administrative Register, Issue Number 9.
2. The department has amended the following rule as proposed: ARM 37.34.3005.
3. The department has thoroughly considered the comments and testimony received. A summary of the comments received and the department's responses are as follows:
COMMENT #1: One commenter supports the department's decision to increase rates for home-delivered meals and encourages the department to monitor the need for additional rate increases.
RESPONSE #1: The department is committed to ensuring waiver members have an array of service providers and services to meet their individual needs. Rate adequacy for meal services, along with most other services for the Developmental Disabilities 0208 waiver is currently undergoing review by the department's contractor, Guidehouse. Following the review, Guidehouse will provide rate recommendations for 0208 waiver services.
4. The department intends to apply the rule amendment retroactively to July 1, 2022. A retroactive application of the proposed rule amendment does not result in a negative impact to any affected party.
