NOTICE OF PUBLIC HEARING ON PROPOSED REPEAL

TO: All Concerned Persons

            1. On July 7, 2014, at 1:00 p.m., the Human Rights Commission will hold a public hearing in the 1st Floor Conference Room of the Walt Sullivan Building, 1315 E. Lockey Avenue, Helena, Montana, to consider the proposed repeal of the above-stated rules.

2. The Department of Labor and Industry will make reasonable accommodations for persons with disabilities who wish to participate in this rulemaking process or need an alternative accessible format of this notice. If you require an accommodation, contact Department of Labor and Industry no later than 5:00 p.m. on June 30, 2014, to advise us of the nature of the accommodation that you need. Please contact Jordon Dyrdahl-Roberts, Department of Labor and Industry, P.O. 3. General Statement of Reasonable Necessity: There is reasonable necessity to repeal each of these rules because they are no longer in use, because they are part of subchapters which have been repealed, and because they are no longer reflective of the practices of the Human Rights Commission. As an example, ARM 24.9.329 describes a commission process applicable only to cases filed before July 1, 1997. All such cases are and have been fully adjudicated, and the explanation of the existence of the old process is no longer necessary.  The proposed repeals reflect an effort of the Human Rights Commission to clarify and to keep concise the rules administered by the commission.
