(1) The parties may, at any period in the negotiations, agree to submit the issues to binding arbitration in accordance with section 39-31-310 , MCA.

(2) Both parties shall jointly notify the board in writing of this decision and of the identity of the arbitrator.

(3) The parties may petition the board to assist in the selection of the arbitrator by requesting that the board submit to them a panel of qualified arbitrators.
