17.24.206    LANDOWNER CONSENT FOR RECLAMATION

(1) An operator shall secure the consent of the owner of the land to be affected by opencut operations to allow the operator, the department, or agents or contractors of the department to enter and reclaim the affected land as provided in the plan of operation.  The landowner consent must be submitted on a form provided by the department.  No application for a permit, or an amendment to add acreage or change the postmining land use, may be approved unless accompanied by a landowner consent form.
