1.3.226    DECLARATORY RULINGS, INTRODUCTION

(1) A person taking or wishing to take a particular action may be unsure whether an agency regulation or a statute administered by an agency applies to that action.  Section 2-4-501, MCA provides that a person may petition the agency for a declaratory ruling as to the applicability of a statute, regulation, or order, to his  activity or proposed activity.
