18.6.103    BASIC PROVISIONS

(1) No person shall establish, operate, or maintain a junkyard, any portion of which is within one thousand (1,000) feet of the nearest edge of the right-of-way of any interstate or primary highway, without obtaining a license from the Department of Highways.

(2) A Junkyard License will be granted only for the following junkyards:

(a) Those which are screened by natural objects, plantings, fences, or other appropriate means so as not to be visible from the main-traveled way of the highway, or otherwise removed from sight.

(b) Those located within an industrial area.

(c) Those which are not visible from the main-traveled way of the highway.

(3) Applications for junkyard licenses may be obtained upon request from the Right of Way Bureau, Montana Department of Highways, 2701 Prospect, Helena, Montana 59601.
