12.14.105    APPLICABILITY OF COMMERCIAL USE RULES

(1) The following rules shall govern commercial use, as defined in ARM 12.14.101, that occurs on lands under the control, administration, and jurisdiction of the department. Unless otherwise noted in these rules, these rules apply to fishing access sites, state parks, wildlife management areas, administrative sites, and other lands under the control, administration, and jurisdiction of the department.

(2) The department may apply these rules to leased lands when the department has authorization to manage use of these lands. This does not include block management lands or lands under a conservation easement.

(3) Noncompliance with the commercial use rules constitutes a violation of commission rules and regulations and as such may be punishable by citation and suspension or revocation of commercial use privileges at department sites.
