(1) The department hereby adopts and incorporates by reference ARM Title 16, chapter 10, subchapter 12 and Title 37, chapter 111, subchapter 10, stating construction and operating requirements for swimming pools and swimming areas. A copy of ARM Title 16, chapter 10, subchapter 12 and Title 37, chapter 111, subchapter 10 may be obtained from the Department of Public Health and Human Services, Health Policy and Services Division, Food and Consumer Safety Section, 1400 Broadway, P.O. Box 202951, Helena, Montana 59620-2951.

(2) The construction and operation of any swimming pool, hot bath, mineral bath, or public swimming place which serves an establishment shall be in accordance with Title 50, chapter 53, MCA, and ARM Title 16, chapter 10, subchapter 12 and Title 37, chapter 111, subchapter 10.
