NOTICE OF AMENDMENT AND REPEAL

 

TO: All Concerned Persons

 

            1. On January 15, 2021, the Department of Labor and Industry (department) published MAR Notice No. 24-142-2 regarding the public hearing on the proposed amendment and repeal of the above-stated rules, at page 34 of the 2021 Montana Administrative Register, Issue No. 1.

 

            2. On February 11, 2021, a public hearing was held on the proposed amendment and repeal of the above-stated rules in Helena via the remote conferencing platform. Two comments were received by the February 12, 2021 deadline.

 

            3. The department has thoroughly considered the comments received. A summary of the comments and the department's responses are as follows:

 

COMMENT 1: One commenter questioned whether the changes proposed in ARM 24.142.502 will affect current license holders in good standing.

 

RESPONSE 1: The department is amending ARM 24.142.502 to remove outdated and unnecessary language that is no longer applicable to the program and does not affect currently licensed individuals.

 

COMMENT 2: One commenter questioned whether mechanics will be required to acquire continuing education this year under COVID-19 restrictions.

 

RESPONSE 2: The department did not propose any amendments to the continuing education requirements in this project. Therefore, the continuing education requirements of ARM 24.142.2102 and 24.142.2103 apply to the program's licensees.

 

            4. The department has amended ARM 24.142.402, 24.142.404, 24.142.502, 24.142.509, and 24.142.510 exactly as proposed.

 

            5. The department has repealed ARM 24.142.405 exactly as proposed.
