24.29.2601    NOTIFICATION WHEN COMPENSATION TO BE CONTINUED BEYOND 104 WEEKS

(1) When a vocationally handicapped person receives a personal injury, the insurer, not less than 90 days nor more than 150 days prior to expiration of 104 weeks from the date of the injury, shall notify the fund if compensation may be payable beyond 104 weeks. The fund shall review the nature of the extent of the injury and disability. If the fund does not notify the insurer of a dispute in the payment of compensation, the insurer shall continue to make payment on the behalf of the fund and will be reimbursed at six month intervals. The fund shall review, at reasonable times, the nature of the extent of injury and disability and determine the continuing liability of the fund.

(2) The insurer shall furnish to the fund information pertinent to the filing of the claim.

(3) Periodic medical examinations of the injured worker may be required by the insurer or the fund.

(4) The fund may notify the insurer of a dispute as to payment of benefits subsequent to 104 weeks.

(5) The liability of the fund to reimburse the insurer shall be suspended 30 days after notice until the controversy is determined.

(6) In the event a dispute or controversy arises as to payment of benefits to the employee, the division may hold a hearing to resolve all disputes.
