24.9.313    INFORMAL DISPOSITION

(1) In accordance with the provisions of ARM 24.9.311 a hearing examiner may make an informal disposition of any matter.

(2) Where a charging party seeks to withdraw a complaint and the only issue remaining to resolve a contested case is the nature, scope and extent of affirmative relief to protect public interests, the department may request informal disposition of a contested case to grant such relief in a proposed order.

(3) The hearing examiner may enter a proposed order upon agreed settlements, consent orders and defaults by means of informal disposition, including telephonic hearings.
