(1) Upon written request and prior to formal application under ARM 42.19.1222, the department will consider the status of a proposed operation with respect to treatment as new industry property. The department after review of the potential applicants written submission issues an opinion letter as to classification of the property in question.

(2) This opinion is based solely on the written material submitted for review and is subject to revision upon review of the formal application.
