(1) Lateral landfill expansions outside the current area licensed to receive solid waste will be considered by the department as equivalent to licensing a new facility under 75-10-221, MCA.   Lateral landfill expansion outside the current area licensed to receive solid waste will not be allowed by the department until the required studies and plans are approved by the department and a license to operate a solid waste management system is issued by the department.
