37.100.135    ADULT FOSTER HOMES, FAIR HEARING

(1) Any person aggrieved by an adverse department action denying, revoking or suspending a license may request a fair hearing in accordance with ARM 37.5.304, 37.5.305, 37.5.307, 37.5.310, 37.5.311, 37.5.313, 37.5.318, 37.5.322, 37.5.325, 37.5.328, 37.5.331, 37.5.334 and 37.5.337.

(2) The licensee shall cease operation of the foster home pending the fair hearing in those instances where the revocation or suspension of the license is based upon actions that the department has determined places a resident in imminent risk of harm or injury.
