(1) An agency may reemploy an employee who previously retired from the agency without a competitive hiring process if:

(a) the retiree possesses the requisite skills and qualifications to perform the duties and responsibilities of the position;

(b) the agency determines that reemployment is in the agency's best interests; and

(c) the reemployment does not exceed 12 months.

(2) An agency must document the reasons for reemployment and why it was determined to be in the agency's best interests.

(3) Reemployment under this rule is subject to the hour and wage limitations set forth for retirees in 19-3-1106 and 19-20-731 , MCA. Questions concerning hour and wage limitations should be directed to the Montana Public Employee Retirement Administration or Montana Teachers' Retirement System.
