20.1.101    ORGANIZATION OF THE DEPARTMENT

(1) The organization and functions of the Department of Corrections and its attached board are described in this rule.

(a) History. The Department of Institutions was established pursuant to the Executive Reorganization Act of 1971 by order of the Governor on December 19, 1973. The Department of Institutions was renamed Department of Corrections and Human Services by the 1991 Legislature. The Department of Corrections and Human Services was renamed Department of Corrections, and extensively reorganized by the 1995 Legislature.

(b) Director. The director of the department is appointed by the Governor with the approval of the Montana Senate, and is responsible for the overall policy development, management direction, planning, and administration of the department's major program responsibilities. The Director's Office is comprised of the Executive Office, Legal Services Office, Office of Human Resources, Office of Investigations, and Quality Assurance Office. Organized below the office of the director are several divisions which provide technical advice and assistance to the director.

(c) Divisions. The department is organized into the following divisions:

(i) Business Management Services;

(ii) Clinical Services;

(iii) Information Technology;

(iv) Montana Correctional Enterprises;

(v) Montana State Prison;

(vi) Montana Women's Prison;

(vii) Probation and Parole;

(viii) Youth Services.

(d) Attached Board. The following board is attached to the department for administrative purposes only.

(i) Board of Pardons and Parole. The Board of Pardons and Parole consists of seven members appointed by the Governor. The board is responsible for the oversight of Montana's inmate parole and furlough programs. In addition, the board reviews requests for Executive Clemency and makes recommendations to the Governor concerning those requests. The board has rulemaking authority as stated in Title 46, chapter 23, MCA, and adopts administrative rules separately from the Department of Corrections.

(2) Functions of the department divisions.

(a) Business Management Services Division. The Business Management Services Division is responsible for managing the department's annual budget and providing fiscal-related support services to all programs including support in the following areas: budget and program planning, contracts management, and accounting.

(b) Clinical Services Division. The Clinical Services Division oversees all medical, mental health, dental and vision services for adult and juvenile offenders in the custody of the department, both in secure and contracted facilities.

(c) Director's Office. The division of the Director's Office provides centralized leadership, determines direction and priorities, and establishes overall policy for the department. The office includes the following work units: the Executive Office, the Legal Services Office, the Quality Assurance Office, the Office of Human Resources, and the Office of Investigations.

(d) Information Technology Division. The Information Technology Division provides the leadership, guidance, and expertise necessary to gather, store, protect, interpret, improve, and present information critical to the department's mission.

(e) Montana Correctional Enterprises Division. The Montana Correctional Enterprises Division includes agriculture, industry, food factory, inmate commissary, license plate factory, support services, inmate hobby store, and vocational education programs of the secure facilities. The division supports the department's mission by providing work and training programs for incarcerated offenders.

(f) Montana State Prison. Montana State Prison provides male felony offenders a secure environment with emphasis on accountability, productivity, and an opportunity of habilitation. The Montana State Prison includes the contract bed unit of the department which oversees contracts with private and regional prisons.

(g) Montana Women's Prison. The Montana Women's Prison provides female felony offenders a secure environment that emphasizes accountability, productivity, and personal growth through educational, vocational, and therapeutic programs.

(h) Probation and Parole Division. The Probation and Parole Division provides community supervision of adult felony offenders in community-based programs and on probation and parole.

(i) Youth Services Division. The Youth Services Division includes the Pine Hills Youth Correctional Facility, Riverside Youth Correctional Facility, transition programs, juvenile parole services, youth interstate compact services, youth placement, transportation, fiscal services, and oversight of youth placement contracts. The division supports the department's mission by holding juvenile offenders accountable for their actions by offering supervision while affording the youth the opportunity for habilitation.

(3) Information or Submissions. Information regarding the department may be found at the department's web site at www.cor.mt.gov. Specific inquiries regarding the functions of each division may be addressed to the head of that division or to the director. All requests for hearings, declaratory rulings, and for participation in rulemaking may be addressed to the director unless the notice in the Montana Administrative Register makes specific provisions for submissions.
