(1) Pursuant to 50-53-103 , MCA, the Building Codes Bureau of the Department of Labor and Industry adopts by reference ARM 37.111.1115, regarding barrier and area requirements, deck area requirements, and handhold requirements as they relate to swimming pool construction. ARM 37.111.1115 is enforced by the Department of Public Health and Human Services and will not be enforced by the Building Codes Bureau.

(2) In accordance with ARM 37.111.1105, the Building Codes Bureau of the Department of Labor and Industry retains all other building regulation authority provided to it by 50-60-101 , MCA, et seq. and by ARM 24.301.101, et seq.
