(1) Notwithstanding any provision of this subchapter, under no circumstances will the plan cover services provided prior to July 1, 1999.

(2) Services provided prior to July 1, 1999 will be subject to the applicable rules in effect prior to July 1, 1999. Member eligibility, service coverage and provider reimbursement will be governed by the rules in effect with respect to the date of service, regardless of any change in the contractual relationship between the department and the Managed Care Organization (MCO). Services provided on or after May 1, 1999 and before July 1, 1999 which meet all requirements will be reimbursed by the MCO according to the MCO's established rates for participating and nonparticipating providers in effect as of April 30, 1999, unless otherwise agreed in writing by the MCO and the department.
