(1) Notification of violation will be furnished to either the registrant or
licensee responsible.
(2) A split of the official sample will be furnished to the responsible party upon
request within 10 days of notification of a violation.
(3) When the registrant or licensee has their portion of an official sample
analyzed and that analysis differs from the department's analysis the
registrant or licensee may request a referee analysis. The referee
laboratory shall be named by the department, all expenses incurred will be paid
by the party requesting the referee. The referee analysis will be
reported to both parties. The analysis of the department or the analysis
of the registrant or licensee that is nearest to the referee analysis shall be
accepted as official. Request for referee analysis must be received by
the department within 30 days from the time the original split is furnished.
